(1) The County Engineer, or their designee, is authorized to carry out inspection and enforcement actions pursuant to Chapter 33.59 CCC, Enforcement, and CCC Title 20, Code Compliance.

(2) If inspection or enforcement investigations by the County Engineer or their designee determines that new land development activity results in significant impacts to receiving water, infrastructure, County roads, or adjoining properties, then a drainage permit may be required to rectify the impacts regardless of the thresholds found in CCC 27.14.050. Failure to comply with the voluntary compliance provisions outlined above to obtain and implement the required drainage permit will be subject to enforcement actions found below.

(3) Any person who fails to comply with the standards contained within this chapter and/or any person who fails to comply with a final written order may be assessed a civil penalty as follows:

(a) The County Engineer, or their designee, may assess the violator a civil penalty not to exceed $1,000 for each violation.

(b) Each violation or each day of continued unlawful activity shall constitute a separate violation. Each day that a person fails to comply with the terms of a final written order shall constitute a separate violation.
